Terms of Use

Bylands Customer Portal · Bylands Nurseries Ltd. · Effective September 10, 2026 · Version 1.0

These terms cover your use of the Bylands Customer Portal (the "Portal"), run by Bylands Nurseries Ltd. ("Bylands", "we", "us"). By creating a login or using the Portal you agree to them. If you use the Portal on behalf of a business, you confirm you are allowed to act for that business.

Who may use the Portal

  • The Portal is for wholesale customers of Bylands who have been invited by their sales representative. Each login is for one person and is tied to one customer account.
  • Keep your password to yourself. You are responsible for what is done under your login, so tell us straight away if you think someone else has used it.
  • We may disable a login at any time, for example when a person leaves the customer's business or when the customer's account with Bylands changes.

What the Portal shows

  • The Portal shows the availability list, prices and quantities that Bylands has set up for your customer account, as they stood at the time shown on the page. Availability changes constantly as plants are sold, graded and grown, so what you see is a snapshot, not a promise of stock.
  • Prices are shown in your account's currency and exclude taxes and freight unless stated otherwise. Errors can happen; if a price or quantity is clearly wrong, Bylands will tell you before an order is confirmed.
  • Some plants are sold in multiples (for example, flats of 8). The Portal rounds quantities up to those multiples, and Bylands' business system does the same.

Requests are not orders until Bylands approves them

  • When you send a request, it is a request to buy, not an accepted order. Your Bylands sales representative reviews it and may accept it, adjust quantities to what can be shipped, or decline it. You will receive an email either way, and the Portal shows the outcome under My requests.
  • An accepted request becomes a Bylands sales order on the date it is approved. Until then, nothing has been reserved for you.
  • You may cancel a request on the Portal while it is still waiting for review. After it has been approved, changes and cancellations go through your sales representative under the terms of sale below.
  • A requested delivery date is a preference. Delivery dates are confirmed by Bylands when the order is approved and scheduled.

Terms of sale

Orders approved through the Portal are supplied under the same terms of sale, credit terms, delivery arrangements and claims, returns and credit procedures that already apply to your customer account with Bylands, including any signed customer agreement. Nothing on the Portal changes those terms. Questions about payment, delivery, plant claims or credits go to your sales representative.

Acceptable use

  • Use the Portal only to view your own availability list and to send requests for your own business.
  • Do not share your login, copy the Portal's data for resale, run automated tools against it, or try to reach information that is not yours.
  • Do not do anything that interferes with the Portal or with other customers' use of it.

Availability of the Portal

We aim to keep the Portal available but we do not promise it will always be, and we may change, suspend or withdraw it or any part of it. If the Portal is unavailable, you can always order the way you did before: through your sales representative.

Liability

The Portal is provided as a convenience for viewing availability and sending requests. To the extent the law allows, Bylands is not liable for losses caused by relying on the Portal's availability or price information, by the Portal being unavailable, or by unauthorised use of your login that you did not tell us about. Nothing in these terms limits liability that cannot be limited by law, or changes the terms of sale that apply to approved orders.

Changes to these terms

We may update these terms. The current version is always at this address, with its effective date at the top. If a change matters to how you use the Portal, we will tell you on the Portal or by email. Continuing to use the Portal after a change means you accept the updated terms.

Law

These terms are governed by the laws of British Columbia and the laws of Canada that apply there, and any dispute about them is heard in the courts of British Columbia.
